In recent years employers have struggled to keep pace with the many changes introduced through Government legislation or from European directive, including enhanced maternity rights, paternity rights, introduction of the National Minimum Wage, data protection, the Human Rights Act, changes in health and safety law, new TUPE legislation, the Working Time Directive and tightening of discrimination legislation, to name just some of the key ones.

All in all, in the last decade, there have been 104 different regulations introduced against business, covering everything from disability discrimination to noise at work. This pace of change shows no sign of abating, with 14 new regulations introduced in the last year. Furthermore, the new equality law in 2010 represents the most significant change to discrimination law with its total reorganisation and harmonising impact. Within this environment it is perhaps unsurprising that many employers feel overwhelmed and uncertain of their ground as to what rights exist and the margins of those rights. This point was echoed by the British Chamber of Commerce which has asked for a three year moratorium on new employment legislation.
